Nevada Traffic Court

Duties of Nevada Traffic Court

Nevada Traffic Court has the authority to conduct trials on misdemeanors, DUI’s and traffic offenses.  Nevada Traffic Court will accept your plea of ‘guilty’ or ‘not guilty,’ set bails, issue warrants for a failure to appear, and determine any other suitable consequence for your traffic infraction.  Nevada Traffic Court is held in the district in which your citation was issued.

If you plead ‘guilty’ in Nevada Traffic Court, your sentence will be immediately imposed.  If you plead ‘not guilty,’ the District Attorney’s Office will be contacted for a pretrial conference and a trial date will be set.  At your trial you can present your case or have an Attorney present on your behalf.  Failure to appear on the trial date will result in a warrant for your arrest issued by the Court.

Nevada Traffic Court Judges can accept voluntary enrollment in and successful completion of Nevada Traffic School as an alternative to assessing demerits on your Nevada Driving Record.  The traffic offense, however, must be a 4 demerit or less violation and must not involve a traffic accident.  Once Nevada Traffic Court receives your Certificate of Completion, the fine and violation will be reduced, thereby eliminating any demerits from appearing on your Nevada Driving Record.  It is important to remember 2 things before requesting Nevada Traffic School:

  • You can only enroll in a Nevada Traffic School to avoid a demerit violation once in a 12 month period
  • You cannot enroll in a Nevada Traffic School to avoid demerits from a violation that resulted in an traffic accident

Appearance in Traffic Court is mandatory for traffic citations involving child restraints, traffic accidents, reckless driving, property damage, driving on a suspended or revoked license and DUI’s.  Your citation will indicate if a court appearance is required; however, you can call the Nevada Traffic Court office before your appearance date if you are unsure about the requirement to appear.

If you are not required to appear in Nevada Traffic Court, you have two options:

  • Pay your full bail amount without attending Nevada Traffic School – in this case, the full amount of demerits will be assessed on your Nevada Driving Record
  • Pay your full bail amount and attend Nevada Traffic School – in this case, your violation will be reduced to a non-moving violation and no demerits will be assessed on your Nevada Driving Record.  This requires authorization from the Nevada DMV.
