DWI Laws

Nevada is governed by the ‘Illegal Per Se’ Law, which means that any adult driver of a motor vehicle with a BAC (Blood Alcohol Content) of .08 or higher is arrested and convicted of a DUI offense regardless of their visible degree of impairment.  For commercial drivers, the ‘Illegal Per Se’ Law recognizes DUI at a BAC of .04 for commercial drivers and .02 for drivers under 21 years old.

The BAC limits set by Nevada are used as guides only, and it is important to note that you can be arrested and convicted for a DUI if your BAC is lower than .08, .04 and .02 respectively if you are exhibiting driving behavior that is indicative of impairment.
